The New European GDPR Is Coming

The current law on data protection will be replaced with a new EU Regulation in May 2018. Despite Brexit looming, the government have confirmed that the new Regulation will be incorporated into our national law too – replacing the current system set out in the Data Protection Act 1998.

If you are a business owner, it is critical that you understand how the regulations affect you, and what your new responsibilities are in terms of how you process and protect personal data, whether that personal data relates to your employees, customers, suppliers or anyone else. You also need to be aware of the increased new penalties for failure to comply. In particular the rules regarding consent by data subjects to the use of their personal data will be significantly tightened, and the rules relating to Data Subject Access Requests (including timescales) will be revised.

In order to protect your business, you need to ensure you have newly compliant policies in place – either by updating existing policies or having new ones created. This is not simply a case of producing a new policy document, but also about understanding how that document and your overall business practices should operate in order to avoid falling foul of GDPR.
