Commercial and Professional Driver Regulations
Road Traffic laws can vary depending on the type of vehicle you are driving. In addition, the penalties imposed for certain offences can be greater if you are driving in your capacity as a professional driver.
Examples of offences which are unique to professional drivers would be speeding where different limits apply to certain classes of vehicle. There are offences such as those relating to drivers’ hours which can only be committed by PSV and LGV drivers. Vehicles which are subject to heavy use are more susceptible to construction and use offences. It is therefore crucial to do daily checks and report defects. Haulage vehicles have the added concern of loading and weight offences to consider.
There are also specialist matters to consider such as animal welfare when moving livestock.
As outlined elsewhere on this site there are requirements to report offences including fixed penalties to the Traffic Commissioner
There are also offences which can be committed by companies and in some circumstances Directors. Companies can be prosecuted for driving related health and safety breaches.
All of this means that it is important to get specialist advice at the earliest opportunity to protect your livelihood.
We are available to discuss any concerns you may have as either a driver or operator. Early advice may avoid a penalty or loss of licence at a later date.
