Taxi Licence Appeals

Can I appeal a decision by the Local Authority?
An appeal to the magistrate’s court is available against any decision of the local authority to refuse to grant a licence or to suspend or revoke a licence.

Should I appeal the decision of the Council and will it succeed?
We can only advise on the prospects of success of an appeal once we know all the facts. An appeal may succeed if it is clear the council have not followed their own policy or have made a mistake in fact or law in their decision making.

Where the council have followed their published policy then an appeal has a limited prospect of success. The Council can make an application for costs where an appeal is unsuccessful and this may be a significant factor in deciding whether to appeal.
