Paul suffered a serious back injury when he fell off a lorry at work. He instructed Personal Injury Team Associate Jemma Burt to make a claim against his employer. The employer raised allegations that the accident was, at least in part, Paul's own fault.
Jemma carefully navigated the claim and argued against any concession of blame on behalf of Paul. Jemma was able to obtain supportive medical evidence and achieve a settlement on a global basis without any acceptance of blame on the part of Paul.
The accident had a big impact on Paul's life, at a time where he was looking to slow down and start the retirement process. He was understandably concerned when his employer, who was a large and wealthy food manufacturing company, made allegations of blame towards him. Jemma supported Paul throughout the process and was able to successfully put arguments forward on his behalf.
Paul's claim settled for £18,000. This included compensation for the injury he sustained, together with a past loss of earnings and a claim for care and assistance which was provided by Paul's family after the accident.
