Office of the Public Guardian

The Office of the Public Guardian is a government agency with responsibilities for England and Wales. It has responsibility for mental capacity policy, and provides guidance to public, legal and health professionals. It supports the Public Guardian with the:

  • Registration of Enduring Powers of Attorney
  • Registration of Lasting Powers of Attorney
  • Supervision of Deputies appointed by the Court of Protection
  • Assistance of Deputies to carry out their duties
  • Protection of people who lack the mental capacity to make decisions for themselves
  • Investigation of allegations of abuse to persons lacking mental capacity

A Court of Protection Deputy is someone who is appointed by Court Order to manage the property and affairs and/or personal welfare of someone who lacks the mental capacity to make decisions them self. If the person lacking mental capacity has not made an Enduring Power of Attorney or Lasting Power of Attorney it may be appropriate for a spouse, relative, friend or in some cases a professional to make an application to be appointed as their Deputy so that they can manage their affairs.

At Sills & Betteridge we have a wealth of experience of dealing with the Office of the Public Guardian and making applications to the Court of Protection. Our team can help you:

  • Prepare and Register an Enduring Power of Attorney
  • Prepare and Register a Lasting Power of Attorney
  • Make an application to the Court of Protection to be appointed as the Deputy of someone lacking mental capacity
  • Make an application to the Court of Protection for other Orders, for example to sell the house of someone lacking mental capacity

Our team would be happy to meet with you at any of our offices, or where necessary they can visit you at home.
