The Office of the Public Guardian is a government agency with responsibilities for England and Wales. It has responsibility for mental capacity policy, and provides guidance to public, legal and health professionals. It supports the Public Guardian with the:
- Registration of Enduring Powers of Attorney
- Registration of Lasting Powers of Attorney
- Supervision of Deputies appointed by the Court of Protection
- Assistance of Deputies to carry out their duties
- Protection of people who lack the mental capacity to make decisions for themselves
- Investigation of allegations of abuse to persons lacking mental capacity
A Court of Protection Deputy is someone who is appointed by Court Order to manage the property and affairs and/or personal welfare of someone who lacks the mental capacity to make decisions them self. If the person lacking mental capacity has not made an Enduring Power of Attorney or Lasting Power of Attorney it may be appropriate for a spouse, relative, friend or in some cases a professional to make an application to be appointed as their Deputy so that they can manage their affairs.
